Terms and Conditions

Last updated 15 October 2026

Please read these terms before using our website or engaging us for services. They explain the basis on which we work and what you can expect from us.

1. About these terms

These terms apply to your use of the NextGen Solutions website and form the general basis on which we provide services. In these terms, NextGen Solutions, we, us and our mean NextGen Solutions Ltd, a company based in Christchurch, New Zealand.

By using this website you accept these terms. If you do not agree with them, please do not use the site.

2. Our services

We provide IT consultancy, managed IT services, cloud services, modern workplace solutions, infrastructure and network systems, and automation, integration and AI solutions.

The website gives general information about what we do. It is not an offer capable of acceptance. Services are provided under a separate proposal, statement of work or service agreement agreed in writing between us and the client. If that document conflicts with these terms, the signed document prevails.

3. Quotes, fees and payment

Quotes and proposals are valid for the period stated in them, or 30 days if none is stated. Fees are in New Zealand dollars and exclude GST unless stated otherwise.

Unless your agreement says otherwise, invoices are payable by the 20th of the month following the invoice date. We may charge interest on overdue amounts and recover reasonable costs of collection.

4. Client responsibilities

To deliver services effectively, we rely on you to provide accurate information, timely access to systems and people, and decisions when we need them. Delays caused by missing access or information may affect timeframes and fees.

You are responsible for having the right to authorise us to work on the systems and data we are given access to.

5. Intellectual property

The content of this website, including text, graphics, logos and design, is owned by or licensed to us and is protected by copyright. You may view and share it for personal or internal business purposes, but you may not copy, modify or reuse it commercially without our written permission.

Ownership of deliverables created for a client is set out in the relevant agreement. Unless agreed otherwise, we keep ownership of our pre-existing tools, methods and know-how, and grant the client a licence to use anything we deliver for its own business purposes.

6. Confidentiality

Each party will keep the other's confidential information private, use it only for the purpose of the engagement, and not disclose it except to people who need to know it or where the law requires.

7. Third party products and services

Our work often involves third party products and platforms, such as Microsoft 365, Azure, Citrix and Xero. Those products are supplied under their own licence terms and we are not responsible for changes, outages or limitations that originate with the vendor.

This website may link to other sites. We do not control them and are not responsible for their content.

8. Limitation of liability

We take reasonable care and skill in providing our services. To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of data or loss of business opportunity arising from our services or your use of this website.

Where we are liable to a client, our total liability for any claim is limited to the fees paid for the services giving rise to the claim in the 12 months before the claim arose.

If you are acquiring services for business purposes, the Consumer Guarantees Act 1993 does not apply to the extent that parties are permitted to contract out of it. Nothing in these terms limits rights that cannot lawfully be excluded, including under the Fair Trading Act 1986.

9. Website availability

We aim to keep the website available and accurate but do not guarantee that it will be uninterrupted or error free. We may change or remove content at any time without notice.

10. Termination

Either party may end an ongoing services arrangement with 30 days written notice, unless the agreement states otherwise. Fees for work done and costs committed up to the end date remain payable.

11. Privacy

How we collect and use personal information is explained in our Privacy Policy, which forms part of these terms.

12. Changes to these terms

We may update these terms from time to time. The version on this page, with its last updated date, is the current version. Continued use of the website after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any dispute.
